By accessing and using the Eyvo Project Delivery Platform ("Service"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including but not limited to internal Eyvo staff, client administrators, and client end-users.
Eyvo provides a cloud-based project management and delivery platform that enables organizations to manage projects, tasks, milestones, documents, and communications between internal teams and external clients. The Service includes features such as Gantt chart visualization, Kanban boards, real-time chat, document management, change request tracking, and notification systems.
To access the Service, you must create an account or be invited by an authorized user. You are responsible for maintaining the confidentiality of your account credentials, including your password and two-factor authentication (2FA) device. You agree to:
Eyvo reserves the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.
The Service operates on a multi-tenant architecture. Each client organization ("Tenant") is isolated so that users associated with one Tenant cannot access data belonging to another Tenant. Client users may only access projects, tasks, and communications associated with their verified Tenant domain. Eyvo internal staff may access data across Tenants as required for service delivery and support.
All client users are required to authenticate using a strong password that meets the platform's complexity requirements and two-factor authentication (TOTP). Internal Eyvo staff authenticate via Google OAuth with @eyvo.com accounts. You agree to comply with all security measures implemented by the Service, including but not limited to:
You agree not to use the Service to:
The Service, including its original content, features, and functionality, is owned by Eyvo, Inc. and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you upload to the Service, but grant Eyvo a license to use such content solely for the purpose of providing and improving the Service.
The Service provides dual-layer communication features. "Public" comments and chat messages are visible to all project participants, including client users. "Internal" or "Private" comments and chat channels are visible only to Eyvo internal team members. You acknowledge that:
If you provide your mobile phone number to Eyvo and opt in to SMS notifications, you consent to receive SMS (text) messages from Eyvo. These messages are transactional and service-related and may include notifications such as project updates, task assignments, approval reminders, account alerts, and customer support messages.
Eyvo does not use SMS for unsolicited marketing messages. We collect and use your phone number solely for the purpose of delivering these service-related communications. Your phone number will not be sold or shared with third parties for their marketing purposes.
Message frequency will vary depending on your use of the platform. Standard message and data rates may apply as determined by your mobile carrier. Eyvo is not responsible for any charges incurred from receiving SMS messages.
You can opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will no longer receive SMS communications unless you re-subscribe. For help, reply HELP to any message or contact Eyvo support at support@eyvo.com.
Consent to receive SMS messages is not a condition of purchasing or using Eyvo services, but certain platform functionalities may be limited without SMS notifications.
By using the Service, you consent to receive email communications from Eyvo, including but not limited to account invitations, password reset codes, project activity alerts, and system notifications. These emails are sent from donotreply@eyvo.org and are essential to the operation of the Service.
The Service allows you to upload, store, and share documents associated with projects. You represent and warrant that you have the right to upload any documents you submit and that such documents do not infringe upon any third party's rights. Eyvo is not responsible for the content of uploaded documents. Uploaded files are subject to size limits and file type restrictions as enforced by the platform.
To the maximum extent permitted by applicable law, Eyvo, Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Eyvo has been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless Eyvo, Inc. and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Eyvo strives to maintain high availability of the Service but does not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control. Eyvo shall not be liable for any loss or damage resulting from service interruptions.
Eyvo reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service or via email. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Marin County, California.
